Civil liberties and civil rights are both similar and different in various ways by means of the United States Constitution, court cases, and legislation. Civil liberties are a constitutional guarantee while civil rights are a government guarantee for the people of America. Though they are much alike in providing people with freedom and individual power, it is important to know the differences. Firstly, civil liberties are constitutional guarantees based on freedom and order. Order comes along with freedom so that it may obtain an orderly fashion and prevent chaos. It is believed by Thomas Hobbes, an English philosopher, that without maintaining order, we would live in a world of nature. Civil liberties guarantee freedom from government interference. According to The Challenge of Democracy, â€Å"the guarantees take the form of restraints on government† because civil liberties state what the government cannot do (Janda, et.al, 2014, p.421). These liberties are very much Constitution-based.
